$1,250,000 Class and Representative Action Settlement Granted Preliminary Approval by the U.S District Court for the Eastern District of California
On February 9, 2022, Judge Dale Drozd of the U.S District Court for the Eastern District of California granted preliminary approval of a $1,250,000 class and representative action settlement in Arredondo v. Southwestern & Pacific Specialty Finance, Inc., (Case No. 1:18-CV-01737-DAD-SKO). The settlement is on behalf of all former and current employees, who worked at Southwestern & Pacific Specialty Finance, Inc. (also known as “Check ’n Go”) in the state of California at any point between February 25, 2018 and February 9, 2022. The Class does not include any individuals who have already resolved the claims asserted in the Action, whether by settlement or adjudication.
The lawsuit claims that Defendant failed to pay workers for all hours worked; failed to pay workers overtime hours; failed to provide workers with lawful meal and rest periods; failed to provide workers with accurate itemized wage statements; failed to timely pay all wages owed to workers who resigned or were terminated; violations of the California Unfair Competition Law; and violations of the California Private Attorneys General Act (“PAGA”). Defendant denies Plaintiff’s claims and denies it did anything wrong.
The Court will hold a Final Approval Hearing at 2:30 p.m. on May 16, 2022, in Courtroom 5 of the U.S District Court for the Eastern District of California located on the 6th Floor at 2500 Tulare Street, Fresno, CA 93721, to determine whether the settlement should be finally approved as fair, reasonable, and adequate.
