Important Notice for Current and Former Employees of Pacific Agri-Products, Inc.
If you worked at Pacific Agri-Products, Inc. (“PacAgri”) between August 6, 2016, and April 30, 2021, you may be affected by a class action lawsuit. This notice, authorized by the Superior Court of California, outlines your potential rights regarding claims of unpaid meal breaks.
Overview of the Lawsuit
Plaintiffs Luis Melchor, Robert Shepner, and Jose Sorto allege that PacAgri did not provide employees with meal breaks as required by law. The Court has certified meal period claims for several subclasses based on job roles and hours worked:
Driver Meal Period Subclasses: For drivers working shifts over five and/or ten hours.
Warehouse Worker Meal Period Subclasses: For warehouse workers, excluding those managing meal policies, who worked shifts over five and/or ten hours.
Office Worker Meal Period Subclasses: For office workers who worked shifts over five and/or ten hours.
Derivative Claims Subclass: For those not timely paid wages due upon termination and/or provided with inaccurate wage statements.
Your Legal Rights and Options
DO NOTHING: Stay in the lawsuit and await the outcome, keeping the possibility of benefits from a settlement or trial. However, you will give up your right to sue PacAgri individually for these claims.
EXCLUDE YOURSELF: Opt out of the lawsuit. You won’t receive any benefits from it, but you retain your right to sue PacAgri on your own.
