$700,000 Class Action/PAGA Settlement Granted Preliminary Approval by the Santa Cruz County Superior Court
On January 3, 2025, the Santa Cruz County Superior Court granted preliminary approval for a $700,000 class action settlement in Eufronio Marcos v. Continental Floral CA, LLC et al. (Case No. 22CV01857). The settlement resolves claims brought by agricultural workers who were employed by the defendants in their facilities in California. These workers were involved in the cultivation, processing, and distribution of floral greens nationwide.
This settlement provides relief for non-exempt employees who worked for Continental Floral CA and Continental Floral LLC at any time between August 29, 2018 and January 3, 2025. The claims made by the Plaintiff include violations of wage-and-hour laws, such as failure to pay overtime, provide proper meal and rest breaks, and reimburse necessary business expenses. Defendants deny Plaintiff’s allegations and deny they did anything wrong.
The Court will hold a Final Approval Hearing regarding the proposed settlement on April 9, 2025, at 8:30 AM in Department 10 of the Santa Cruz County Superior Court.
